1) Acceptance
By using this site or scheduling service with Scottish Tom Heating & Air Conditioning LLC(“Scottish Tom,” “we,” “us”), you agree to these Terms and our Privacy Policy.
2) Services & estimates
- We provide residential HVAC diagnostics, repairs, maintenance, installations, and related electrical work where licensed.
- Estimates are based on the visible scope at the time and may change if hidden conditions are discovered. We always review changes with you for approval.
3) Scheduling & access
- We’ll do our best to meet requested dates/times and will communicate promptly about any delays.
- You agree to provide safe access to equipment and work areas, including power and clearances required by code.
4) Pricing & payment
- Service call fee: $195, credited toward the repair when you proceed with work during the diagnostic window.
- We’ll present pricing before work begins. Certain projects may require a deposit.
- We accept major credit/debit cards via secure payment processor (e.g., Stripe). Invoices are due upon receipt unless otherwise stated in writing.
5) Membership plan
If you enroll in our Home HVAC Assurance plan, the plan’s features, pricing, and renewal/cancelation terms are described on the Plans page and your checkout confirmation. Any changes will be communicated in advance per that agreement.
6) Warranty
Parts carry the manufacturer’s warranty when installed and registered per their requirements. Our workmanship warranty is stated on the invoice for your specific job. Warranty coverage does not apply to misuse, lack of maintenance, or conditions beyond our control (e.g., weather events, pre-existing issues).
7) Customer responsibilities
- Provide accurate information about your system and needs.
- Authorize decisions if you’re the owner or have authority.
- Follow safety guidance and post-service care instructions.
8) Site use
You agree not to misuse our website (e.g., no scraping, unauthorized access, or interfering with operation). Content on this site is provided “as is” for general information and may change without notice.
9) Third-party links & tools
We may link to or embed tools from vendors like Housecall Pro or payment providers. Their terms and privacy policies govern your use of those services.
10) Disclaimers
Except as expressly stated, we disclaim warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow disclaimers of implied warranties—your rights may vary.
11) Limitation of liability
To the fullest extent permitted by law, Scottish Tom will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the site or services.
12) Indemnification
You agree to indemnify and hold Scottish Tom harmless from claims arising out of your misuse of the site or violation of these Terms.
13) Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Venue lies in the state or federal courts located in Orange County, CA.
